This contract entered into this ____day of ____ __, 2009 by and between the UNIVERSITY SCHOOL OF JACKSON MOTHERS’ CLUB, herein referred to as “Mothers’ Club” and , herein referred to as “Exhibitor,” states the following: Mothers’ Club shall hold its annual HOLIDAY MART beginning November 20 and ending November 23, 2008 at the Carl Perkins Civic Center in Jackson, Tennessee; shall make the arrangements and program thereof; and shall conduct a merchandise and antique display or exhibition in connection therewith.
In consideration of the sum of $ for one standard/premium 8' x ' booth on the Level cash in hand paid by the Exhibitor to Mothers’ Club, the Exhibitor does hereby rent from the Mothers’ Club a merchandise display booth. The location shall be designated by the Mothers’ Club and requests will be considered on a first come, first served basis with FULL payment. The Exhibitor shall set up his/her booth or display area on November 18 and 19, 2009 between the hours of 9:00 am and 11:00 pm and 8:00 am and 5:00 pm, respectively, and shall remove all contents of the same between 5:00 pm and 11:00 pm on November 22, 2009. Any and all merchandise not so removed will be considered a donation to the Mothers’ Club.
The Mothers’ Club shall give broad advertising and publicity to the event.
The Mothers’ Club and Exhibitor both agree to abide by and be governed by the Policies & Procedures of the University School of Jackson Holiday Mart and the rules and regulations of the Carl Perkins Civic Center of Jackson, Tennessee in their use of the facility.
I, the applicant, must make provisions for the safeguarding of his/her products, services, or merchandise so displayed from the time they are placed in his/her booth until they are removed by him/her. Exhibitor agrees to insure his/her products, services, and merchandise against fire, accident, theft or any loss or injury to same during the contracted period and agrees to release and hold harmless the Mothers’ Club against any and all claims, actions, damages, liability and expense in connection with loss of life, personal injury, and/or damage to property arising from or out of the occupancy or use by Exhibitor of the rented premises or any part thereof or any other part of the Carl Perkins Civic Center and/or its equipment, occasioned wholly or in part by any act of omission of exhibitor, its agents, contractors, or employees.
All 2009 exhibitors must pay to the Mothers’ Club a deposit of 50% of the total booth rental by March 31, 2009 to secure previous location. All new applicants must include 50% deposit with application and contract. All deposit monies are non-refundable. The balance of payment is due by August 31, 2009. If the balance of payment is not received by hand or postmarked on or before August 31, 2009, the deposit will be forfeited, and the booth will be made available to other parties. Each of the parties hereto shall have the right to cancel by written notice addressed to the other party and hand delivered in person or postmarked on or before September 30, 2009. Before September 30, 2009, if cancellation occurs, Exhibitor may request in writing the refund of paid balance. After September 30, 2009, if cancellation occurs, all monies, deposit and balance, will be forfeited.
